LG035: New-The Construction Act is Coming: of Prompt Payment, Adjudication and New Lien Procedures
On December 12, 2017, the Construction Lien Act Amendment Act, 2017 was passed into law. When its substantial changes come into force, the Construction Lien Act will become the "Construction Act". The changes will most likely have a greater impact on the construction industry in Ontario than has anything else that has occurred since the Second World War.
Most significant will be the prompt payment requirements and adjudication procedures set out in the new legislation. These are designed to help trades and contractors get paid in a timely fashion and at substantially reduced expense. Other significant changes include new lien procedures, more flexible lien limitation periods and enhanced trust obligations.
You will have to put systems in place if you are to manage, and take advantage of, the changes. In this seminar, Rob Kennaley will outline how the changes will effect your business. Practical approaches and procedures which can help you use the legislation to preserve and defend claims, resolve disputes and get paid will be discussed.
